Terms of Service

1. Definitions

1. "the Service" means the services provided under the name Japan Auction Agency: bidding on and purchasing goods from Japanese auction sites and online shops on your behalf, and the storage, forwarding and international shipping of those goods.
2. "we", "us", "our" means Nissin International Inc., the company that operates the Service.
3. "you" means the individual or company using the Service under these Terms.
4. "goods" means items we win, purchase or receive on your behalf, including parcels you send to our warehouse yourself.

2. Nature of the Service

1. We bid on and purchase goods on your behalf and for your account. We are not the seller. We make no warranty as to the quality, authenticity or legality of any goods.
2. The contract of sale is formed between you and the seller or shop. We are not a party to it.
3. We do not negotiate with sellers or shops on your behalf, and we do not pursue returns, exchanges, price reductions or any similar claim for you.

3. Registration

1. You must register an account to use the Service.
2. You confirm that the information you register is true, and you agree to keep it up to date.
3. We may refuse or cancel a registration if:
   • the information registered is false;
   • your account was previously cancelled for breach of these Terms; or
   • we otherwise consider the registration unsuitable.

4. Fees

1. In addition to the price of the goods, the following fees apply.

2. Your membership rank is determined by us based on your purchases in the previous month. Your current rank and rate are shown in your account.
3. We may revise our fees. Revisions take effect when published on our website and apply to orders placed on or after that date.

5. Orders and cancellation

1. A contract between you and us is formed when you place an order through the Service and we confirm receipt of it.
2. A bid cannot be withdrawn once placed.
3. An order cannot be cancelled once the item has been won or purchased. If you decline to accept the goods after that point, no refund of the item price or fees will be made.
4. If we do not win the auction, or the shop cannot supply the item, the amount held for that item is returned to your account balance.

6. Payment

1. You pay the estimated item price and fees in advance when you place your order.
2. You may pay from your account balance, by PayPal, or by bank transfer.
3. If payment by PayPal is not completed within the time we specify, the order is cancelled automatically. You are free to place the order again.
4. If the winning bid is lower than your maximum bid, the difference is returned to your account balance.

7. Account balance

1. Money we receive from you that is not applied to item prices or fees is held as your account balance.
2. No interest is paid on your balance.
3. A balance expires five years after the date you last used the Service. We will notify you by email at least 30 days before this happens.
4. You may request the return of your balance at any time. Remittance charges and any other costs of returning the money are borne by you and deducted from the amount returned.

8. Storage

1. We store goods at our warehouse free of charge.
2. The storage period is 12 months from the date we receive the goods.
3. We will email you before the period ends:

4. Once the storage period has passed, we may dispose of or sell the goods without further notice. We are not obliged to refund the item price or any other amount, and any proceeds of sale belong to us.
5. We will not charge you for the cost of disposal.

9. Shipping

1. We ship only when you submit a shipment request through the Service. We will not ship goods without your request.
2. International shipping costs are confirmed after packing. Goods are shipped once you have paid the confirmed shipping cost and any related charges.
3. You may choose a carrier when you submit a shipment request. If that carrier cannot be used because of the size, weight or contents of the parcel, we will suggest an alternative.
4. We are not liable for damage, delay or loss in transit, except where shipping insurance has been taken out under clause 10.
5. Customs duties, import taxes and any other charges levied in the destination country are your responsibility. We do not pay them on your behalf.

10. Shipping insurance

1. You may add shipping insurance when you submit a shipment request. The premium and the scope of cover are as shown in the Service.
2. Compensation for damage or loss in transit is available only where shipping insurance has been taken out, and is subject to the policy terms and the insurer's assessment.
3. Where no insurance has been taken out, we accept no liability whatsoever for damage or loss in transit.

11. Goods that cannot be exported

1. We decline orders for goods whose export or carriage is prohibited or restricted by law or by carrier regulations.
2. If we discover after accepting an order that the goods cannot be exported, we will not ship them internationally. No refund of the item price or fees will be made.
3. In that case you must choose one of the following, and follow our instructions:
   • forwarding to an address in Japan, at your own cost; or
   • disposal by us.
4. If you do not make that choice within the storage period set out in clause 8, we may dispose of the goods in accordance with clause 8.4.

12. Limitation of liability

1. We make no warranty as to the quality, condition, authenticity or legality of any goods. No refund or compensation is available where goods turn out to be counterfeit or imitation.
2. We are not liable where the goods differ from the seller's or shop's description.
3. We are not liable for delay in or failure of performance caused by natural disaster, war, epidemic, communication failure, system failure, carrier circumstances or any other cause beyond our control.
4. Our total liability to you in respect of any transaction is limited to the fees you paid us for that transaction.

13. Prohibited conduct

You must not:

1. use the Service for any unlawful purpose;
2. register false information;
3. fail to make payments due;
4. infringe our rights or those of any third party;
5. interfere with our business; or
6. use the Service while impersonating another person.

14. Suspension and cancellation

1. If you breach these Terms, we may suspend your use of the Service or cancel your registration without prior notice.
2. In that case we will contact you about the goods we hold and your account balance, and give you a reasonable period in which to give us instructions.

15. Changes to these Terms

1. We may change these Terms.
2. Changes take effect when published on our website.
3. We will notify you by email of any significant change.

16. Governing law and jurisdiction

1. These Terms are governed by and construed in accordance with the laws of Japan.
2. The Yukuhashi Branch of the Fukuoka District Court shall have exclusive jurisdiction as the court of first instance over any dispute arising in connection with the Service.

Supplementary provisions

1. These Terms take effect on 19 October 2026.
2. For goods received by us before that date, the storage period under clause 8.2 runs from 19 October 2026.
